6.  Protection of Personal Information (POPI) Act

6.1. Landela Campsite Trust recognises and complies with the POPI Act,

6.2. This site collects personal information from users and such information shall not be disclosed to any third party unless agreed upon between the user and Landela Campsite Trust or through due legal process. Users agree that Landela Campsite Trust may from time to time communicate with users.

6.3. The POPI Act changed the manner in which consent was regarded for direct marketing purposes and regulates the sending of unsolicited commercial communications with an “opt-in” mechanism for consumers.  This means that processing of the personal information of a data subject for the purposes of direct marketing by means of any form of electronic communication is prohibited, unless the data subject has specifically consented to the processing; or is a customer of the responsible party doing the marketing.

6.4. The act allows Landela Campsite Trust to approach a data subject (who has not previously withheld consent) only once to request consent for processing the data subject’s personal information for direct marketing purposes. The data subject’s consent must be obtained in the prescribed manner and form.

6.5. Landela Campsite Trust makes use of Google services to generate maps and provide autocompletion when searching for events by location, which may collect data via your browser in accordance to Google’s privacy policy.

6.6. Landela Campsite Trust will collect and store information you submit to us when making a booking, for the purpose of reserving your requested spaces at our event and maintaining a record of attendance.

6.7. Landela Campsite Trust may use cookies to temporarily store information about a booking in progress as well as any error/confirmation messages whilst submitting or managing your events and locations.

6.8. You may log into your use profile at any stage to see what records we have on you and may change / delete your records as you wish or request us to alter or remove your records.

7.  Security

7.1. Any person that delivers or attempts to deliver any damaging code to this website or attempts to gain unauthorised access to any page on this website may be prosecuted and civil damages may be claimed in the event that Landela Campsite Trust suffers any damage or loss.

8.  Amendments

8.1. Landela Campsite Trust may, in its sole discretion, change these disclaimers and terms and conditions or any part thereof at any time without prior notice.

8.2. Landela Campsite Trust does not guarantee that the Acts displayed on this website reflect the most recent version of those Acts after any possible amendments.

9.  Governing Law

9.1. This site is hosted, controlled and operated from the Republic of South Africa and therefore South African law shall govern the use of this site and/or any agreement flowing there from.

10.  Disputes

10.1. All disputes in terms of the use of this website or any agreement flowing there from, or relating to the inability to use this website, will be referred to arbitration in terms of the rules of the South African Arbitration Foundation (AFSA) and such arbitration shall be held in Johannesburg, and conducted in the English language, and the unsuccessful party shall pay all costs incurred by the successful party.
